Terms of Service: updated 2/11/10

1. DISCLAIMER

Digital Future Live offers computer service, repair and upgrading services as is. We believe business should be conducted honestly, fairly and be subject to reasonableness. We strive to provide the highest quality of service and support. We cannot guarantee specific results for our services, but will operate under the principles stated above and expect you to do the same.

2-A. PAYMENT TERMS

Digital Future Live offers free evaluation of your problem with an On-Duty Technician. If determined that Digital Future Live can fix your problem using Digital Future Live Support, a form of payment must be provided before the service is performed. Full payment is due upon completion of service. Failure to pay may result in the debt being turned over to a collections agency and reported to the credit bureau. You will be responsible for all costs incurred by Digital Future Live, collection agencies, and/or legal fees due to failure of payment. If Digital Future Live is unable to fix your problem using
Digital Future Live Support, other options will be presented to you and you will not be charged for your Digital Future Live Support session.

 

2-B. PROMOTIONS

 

All promotions are limited to one promo code per person unless otherwise stated within the promotion itself.  If you have received either a free or discounted promo code and we determine that Digital Future Live is unable to perform the service on your computer due to other issues not covered by the promotion (eg. virus on computer and promo is free tune up), Digital Future Live may choose to honor the promotion up to an additional seven (7) days to allow time for you to get the issue resolved, either by Digital Future Live or alternate methods.

3. GUARANTEE

Fees will be refunded if Digital Future Live Support is unable to solve your problem.  Once an order has been placed, it is the sole discretion of
Digital Future Live to decide whether or not we can resolve the problem.  In some instances, research time may be needed in order to find a resolution to the problem.  In these instances, if the problem is resolved by a third party during this time, this does not constitute Digital Future Live not being able to resolve the problem and your fees will not be refunded.  In some instances, it may be required for you to obtain hardware at the request of the technician. In these instances, your ticket will remain open for seven (7) days in order for you to obtain the hardware to complete the service. Failure to obtain and/or call Digital Future Live back to complete the service does not constitute Digital Future Live not being able to solve your problem and fees will not be refunded. In other instances, your original Windows installation disk will be required to resolve your issue. In these instances, your ticket will remain open for seven (7) days in order for you to obtain a replacement disk.  Failure to obtain or the absence of this disk does not constitute Digital Future Live not being able to solve your problem and fees will not be refunded.  All services include a 7 day guarantee from completion date of original service.

4. LIABILITY

We provide our services in an effort to repair and/or upgrade the computer system for which such services are requested.  Depending on the type of problem(s) you are experiencing, there is always a risk of damage or loss of data during the repair process.  As a result, Digital Future Live, or any persons acting as an agent of Digital Future Live, will not be liable for any damage, further damage, or loss of data associated with existing problems with your system (i.e. viruses, misconfigured software, hardware problems/failures, etc.).

5. SERVICE AND SUPPORT

Customer satisfaction is
our number one priority.  We provide free consultations to determine the feasibility and scope of work needed to repair and/or upgrade your computer system.  At which point Digital Future Live and the client mutually agree on the service to be provided, payment is due in full.  In turn, Digital Future Live will provide support as part of the 7 day guarantee (see section; 3. GUARANTEE).

Terms of Platinum and Platinum Plus Services Agreement

6-A. DESCRIPTION OF SERVICES

Digital Future Live will provide to Client the following services (collectively, the "Services"):

Unlimited Support Services for one (1) computer with Platinum Membership.

Unlimited Support Services for three (3) computers with Platinum Plus Membership.

6-B. SERVICES COVERED AND NOT COVERED

Digital Future Live Support Membership covers all of our services described on our site; including all necessary software and limited hardware problem diagnosis/configuration.
Digital Future Live services do not cover any hardware replacement.


6-C. PAYMENT
 

Platinum Monthly:
Client agrees to pay an initial set-up fee of $69.99 which includes first month payment. A monthly fee will then be billed beginning on the anniversary day of membership of second month for a total minimum term of twelve (12) months. If funds are not available in the clients account at time of billing, we will reattempt to charge the clients card.  If payment becomes thirty (30) days past due, the total remainder of contract amount is due in full. 

 

Prepaid Platinum:

Prepaid Platinum Memberships will be billed in full every twelve (12) months unless otherwise terminated. 

Set-up fees do not apply.


6-D. TERM

Platinum Monthly:

This Agreement will remain in effect for a period of twelve (12) months and is non-refundable. This constitutes the initial terms. Platinum Monthly Memberships automatically renew on the anniversary date of initial set-up.  An early termination fee of 75% of the remaining cost of the term will be charged to the client, as reasonable charges for liquidated damages if this Agreement is terminated before the initial term date.  To properly cancel, client must notify by Email at least 15 days before the anniversary date of initial set-up with a 'do not renew' notice.

 

Prepaid Platinum:

Prepaid Platinum Memberships are automatically renewed on the anniversary date of initial set-up.  To cancel renewal, client must notify by Email at least 15 days before the anniversary date of initial set-up.

Digital Future Live reserves the right to terminate this agreement at our discretion.


6-E. TRANSFER

In the event the customer purchases or acquires a new computer during the twelve (12) month period of the Agreement, a one (1) time transfer of service is available.  Any additional transfers within a given year will require a one time set-up fee of $69.95 per new computer.

 

 

7. INDEMNIFICATION

Client agrees to indemnify and hold Digital Future Live harmless from all claims, losses, expenses, and/or fees including attorney fees, costs, and judgments that may be asserted against Digital Future Live.


8. ENTIRE AGREEMENT

This Agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Agreement. This Agreement supersedes any prior written or oral agreements between the parties.


9. GOVERNING LAW

This Agreement shall be construed in accordance with the laws of the State of Nevada.
